WHAT ARE THE ACCEPTABLE
GROUNDS FOR DIVORCE IN OHIO?

In the state of Ohio, you essentially have two options when filing for divorce. You can either file for divorce under the basis of fault or no-fault. Typically, those who file for divorce using fault grounds do so in an attempt to gain an advantage over a custody battle or a potential property dispute. Generally speaking, the traditional fault grounds you can use for filing divorce include:

  • Cruelty - This can be defined as any time a spouse inflicts unnecessary emotional or physical pain.

  • Adultery - This is defined as any time a spouse is found to have committed adultery during the marriage.

  • Abandonment - This is defined as any willful absence for more than one year.

  • Prison Confinement - This can be used when a spouse is sentenced to a lengthy prison sentence.

  • Incompatibility – Unless denied by your spouse. This would be considered Ohio’s “No-Fault” basis for divorce.
