Divorce may be a household term, but it's important for you to know that it isn't your only option when it comes to legal separation. Another option that a couple may choose is the dissolution of marriage because that may be the better choice for them and their family. What is a dissolution of marriage, and how does it differ from a simple divorce? Our attorneys at Heckert & Moreland Co., LPA in Columbus, Ohio can help you determine the better option for you and your spouse.

SHOULD YOU CHOOSE DIVORCE OR DISSOLUTION IN OHIO?

In the state of Ohio, you cannot file a petition for dissolution until both you and your partner have settled any issues regarding parental rights, child support, alimony, division of property, and related considerations. There are many moving parts to ending a marriage, so hiring a dissolution of marriage attorney to guide you through the proceedings can save you time, energy, and money.

We at Heckert & Moreland Co., LPA have over two decades of combined experience helping couples sort out their issues before filing in Columbus. HOW DOES THE DISSOLUTION OF MARRIAGE WORK?

After you and your attorneys have done the work of allocating alimony, child support, child custody, asset division and related matters, then a signed separation agreement is then filed with the petition for dissolution. Following the filing, the court will be in contact with you to schedule a hearing date, which must be within 30 to 90 days after you have filed the petition.

At the hearing, both you and your spouse must be present to show the judge that you both entered into the separation on your own terms without being coerced by either the other party or someone else. In addition, you each must tell the judge you're okay with the separation agreement and still want to dissolve your marriage. If the judge approves your petition, they will take steps to make the dissolution an official court order.

As you can tell, this process is much simpler and more civil than divorce, which can take several months to a couple of years from start to finish. If civility and simplicity is what you and your spouse are looking for, a dissolution of marriage is likely your best option.
