Violation of Probation or Community Control
Probation is a method by which the court seeks to punish an individual for a conviction, but it also allows a person to acquire assistance and guidance with a particular problem. Certain conditions may be imposed in addition to, or instead of, incarceration. If any terms of the probation are violated, the consequences can be severe. The attorneys at Heckert & Associates have extensive experience in defending clients charged with a probation violation.
There are two types of probation violations that may occur:
Technical Violation
If you have committed a technical violation of your probation, you have not necessarily committed a crime.
Examples of a technical probation violation include:
- Failure to attend a court-mandated class, such as anger management
- Failure to submit to a drug test
- Failure to complete required community service
- Failure to meet your probation officer at the designated time
New Law Violation
As the name indicates, probation can be violated by being charged with a new crime while already on probation. Depending on the terms of your probation, any new offense may constitute a probation violation.
If your probation officer petitions the court based on a probation violation, a revocation hearing is scheduled. You must appear at this hearing and either admit or deny the accusations. The hearing is held before the original sentencing judge. In this situation, it is better to have your attorney present to defend you. The judge will determine if the terms of your probation have been violated and what punishment to impose. The judge may continue or extend your probation with the same conditions, or the judge may impose more severe terms, such as the imposition of any suspended jail time.
When you retain an experienced lawyer who understands this process, you increase your chance of obtaining a successful resolution to the hearing. We encourage you to contact a Columbus probation violation attorney at Heckert & Associates.
